Happy’s Car Wash Unlimited Membership Terms

PLEASE READ THESE TERMS CAREFULLY. These terms govern your purchase and use of the Happy’s Car Wash Unlimited Membership. By signing up for a membership, you agree to these terms, including the Arbitration Agreement and Class Action Waiver detailed in Section 5.1. Membership Overview

1.1 The Service Happy’s Car Wash (“we,” “us,” or “our”) provides unlimited car wash services for the specific vehicle enrolled in the selected plan. Services are available during normal business hours and may vary by location or be affected by weather, maintenance, or force majeure events. We reserve the right to close locations for holidays or upgrades without compensating for lost wash days.1.2 Auto-Renewal YOUR MEMBERSHIP AUTOMATICALLY RENEWS MONTHLY. By providing a payment method, you authorize Happy’s Car Wash to charge your credit or debit card on a recurring monthly basis until you cancel. The recurring charge will happen on the same day of the month as your initial sign-up (your “Billing Date”).

1.3 Vehicle Identification (License Plate Recognition) We utilize License Plate Recognition (LPR) technology to identify your vehicle and grant access to the wash.Plate Visibility: You agree that the license plate on the registered vehicle must be clearly visible, readable, and free of heavy obstruction or damage to ensure proper recognition.Updates Required: If you purchase a new vehicle, get a new license plate number, or receive a temporary tag, you must update your membership information immediately at a wash location or via our website to avoid interruption of service.

1.4 Single Vehicle Use Memberships are valid for one specific vehicle only.

2. Billing, Cancellation, and Refunds

2.1 Pricing and Taxes The price of your membership depends on the package selected at the time of purchase. Prices are subject to applicable state and local taxes, which will be added to your monthly recurring charge. We reserve the right to adjust pricing; however, we will provide at least 30 days’ notice of any price increases.

2.2 Payment Processing If your payment method is declined due to expiration, insufficient funds, or other issues, we may suspend your membership access until a valid payment method is provided. You are responsible for any fees charged by your bank for declined transactions.

2.3 Cancellation Policy YOU MAY CANCEL AT ANY TIME. To avoid being charged for the next billing cycle, you must cancel at least 7 days prior to your Billing Date.How to Cancel: You may cancel by visiting our website at https://www.happyswash.com/, visiting a wash location, or contacting customer support.Post-Cancellation: If you cancel, your pass will remain active until the end of the current paid billing cycle.

2.4 No Refunds Membership fees are non-refundable. There are no partial refunds or credits for months where the service was not utilized, or for partial months following a cancellation.3. User Accounts and Communication

3.1 Account Management You must be at least 18 years old to purchase a membership. You are responsible for keeping your account information (including contact info and vehicle details) current.

3.2 Communication By providing your email and phone number, you consent to receive electronic communications regarding your account, payments, and membership changes. You also agree to receive transactional text messages related to your account billing. You may opt-out of marketing communications, but account-status notifications are mandatory for active members.

3.3 Termination by Us Happy’s Car Wash reserves the right to terminate your membership at any time for any reason, including violation of these terms, fraud, or conduct deemed inappropriate at our facilities.4. Liability and Disclaimers

4.1 "As Is" Service Our services are provided on an "AS IS" basis. We do not guarantee that our equipment is suitable for every vehicle modification.

4.2 Damage Disclaimer Happy’s Car Wash is not responsible for damage to your vehicle related to:

Pre-existing damage (rust, loose molding, peeling paint).
Aftermarket accessories (roof racks, non-factory antennas, bug shields).
Open windows or sunroofs.
Loose items in truck beds.
Electric running boards left in the lowered position.
Collision due to driver negligence (braking or steering in the tunnel).

4.3 Limitation of Liability To the maximum extent permitted by law, Happy’s Car Wash shall not be liable for any indirect, incidental, or consequential damages. Our total liability to you for any claim shall not exceed the amount paid by you for the membership in the one month preceding the claim.5. Dispute Resolution

5.1 Binding Arbitration Any dispute or claim arising out of your membership or these terms shall be resolved by binding arbitration, rather than in court. You are waiving your right to a trial by jury.

5.2 Class Action Waiver You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

5.3 Venue The arbitration or any legal action allowable under these terms shall take place in [Insert Your County], [Insert Your State], and be governed by the laws of [Insert Your State].6. Miscellaneous

6.1 Changes to Terms We may update these terms from time to time. Continued use of your membership after changes are posted constitutes your acceptance of the new terms.

CONSUMER OPT IN

Happy's Car Wash provides opted-in consumers with promotional alerts and important communications from car washes that utilize our technology. Messaging is recurring, and frequency may vary. Message and data rates may apply.

By signing up for the mobile alert service, you are consenting to receive automated ongoing alerts to the phone number you have provided. Your consent is not required to purchase goods or services.

For standard-rate alerts, end users will opt-in by texting the keyword shown on the advertisement to the SHORT CODE listed.

You will not receive any unsolicited messages from this short code.

To receive information about the service from your cellular phone you can send HELP to the SHORT CODE, email guestservices@happyswash.com, or call (707) 586-9934

Opt-Out: You can cancel your receipt of the service by sending STOP QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to any text message you receive or to the SHORT CODES.

Message and data rates may also apply according to your specific cellular plan or prepaid conditions.

CONSUMER PRIVACY

We will not share or use your mobile number for any other purpose.

CONSUMER FEES

Our service never charges consumers to 'receive' or 'reply to' text messages. However, depending on your mobile service plan, message & dates rates may apply.

CONSUMER OPT-OUT

To Opt-Out (discontinue service), text "STOP" to the Short Code from your mobile device. You will not receive any additional messages. You may also Opt-out by texting "QUIT", "END", "CANCEL", "UNSUBSCRIBE", or "STOP ALL" to any text message you receive.

Happy's Car Wash respects your privacy. We will only use information you provide to transmit your text message. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the Service, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate, or incomplete, we may refuse you access to the Service and pursue any appropriate legal remedies.

You may cancel your monthly software subscription at any time, just be sure to cancel before your plan renews - as we cannot provide partial-month refunds. If you believe you have been billed the wrong amount, please contact us at: guestservices@happyswash.com
